Please read these terms carefully before using our GPS audio tour services.
These Terms of Service constitute a legally binding agreement between you and Eastern Cape Frontier Tours. By using our services, you acknowledge that you have read, understood, and agree to be bound by these terms.
By accessing or using the Eastern Cape Frontier Tours website, mobile application, or GPS audio tour services (collectively, the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our Service.
Eastern Cape Frontier Tours provides self-guided GPS audio tours of historical sites related to the Eastern Cape Frontier Wars. Our Service includes:
To purchase and download tours, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, illegal, or harmful activities.
Tour prices are displayed in South African Rand (ZAR) and include VAT where applicable. Prices may change without notice, but changes will not affect orders already placed.
Payments are processed securely through third-party payment providers. We do not store your payment card information on our servers.
Each tour purchase includes a license to install the tour on up to three (3) devices for personal, non-commercial use by immediate family members.
We offer full refunds within seven (7) days of purchase provided you have not started the tour. Refunds are processed to the original payment method within 5-10 business days.
If you experience technical difficulties that prevent tour completion, contact our support team. We will provide technical assistance and, if the issue cannot be resolved, may offer a partial or full refund at our discretion.
Refunds for safety-related cancellations (severe weather, road closures, medical emergencies) are considered on a case-by-case basis.
You agree to use our Service only for lawful purposes and in accordance with these terms. You will not use the Service in any way that violates applicable laws or regulations.

IMPORTANT: Participating in self-guided tours involves inherent risks including but not limited to vehicle breakdown, adverse weather conditions, wildlife encounters, uneven terrain, and remote location challenges. You participate at your own risk.
You acknowledge that you have read our safety guidelines and agree to follow all safety recommendations. You are solely responsible for your safety and the safety of your companions during tours.
While we provide emergency contact information and support, you are responsible for your own emergency preparedness and response. In emergencies, contact local emergency services (112) immediately.
All tour content, including audio files, maps, text, images, and software, is owned by Eastern Cape Frontier Tours or our licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to download and use tour content for personal, non-commercial purposes only. This license does not include the right to distribute, modify, or create derivative works.
If you submit reviews, photos, or other content to us, you grant us a worldwide, royalty-free license to use such content for promotional and operational purposes.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or use, regardless of the theory of liability.
Our total liability to you for all claims related to the Service shall not exceed the amount you paid for the specific tour giving rise to the claim.
You agree to indemnify, defend, and hold harmless Eastern Cape Frontier Tours, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these terms, or infringement of any rights of third parties.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We may also modify these terms by posting updated terms on our website.
The Service requires compatible devices with GPS capability and sufficient storage space. We do not guarantee compatibility with all devices or operating system versions.
These terms are governed by the laws of South Africa, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
We encourage resolving disputes through direct communication. If informal resolution is unsuccessful, disputes may be subject to binding arbitration under South African arbitration rules.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force. These terms, together with our Privacy Policy, constitute the entire agreement between you and Eastern Cape Frontier Tours.
